What is a lemon?
Under South Carolina law, a lemon is a new passenger motor vehicle that meets the following conditions: (1) the vehicle does not conform to all applicable express warranties within the first twelve months of purchase or the first twelve thousand miles of operation, whichever occurs first; (2) has a defect or condition that substantially impairs the use, value, or safety of the vehicle that is not the result of an accident, modification, or alteration; and (3) a reasonable number of attempts have been made to repair the same defect or condition, but the issue continues to exist.
Does lemon law apply to used vehicles?
Under South Carolina law, the lemon law applies to only new vehicles. However, you may still have under rights under general sale and warranty laws if your used purchased or leased vehicle was sold with an express or written warranty.
