What is medical malpractice?
Medical malpractice means a health care provider or health care institution has breached the standard of care in diagnosing or treating medical conditions. According to South Carolina law, this means doing that which the reasonably prudent health care provider or health care institution would not do or not doing that which the reasonably prudent health care provider or health care institution would do in the same or similar circumstances.
Is there a time limit on how long I have to file a lawsuit?
In general, you must file within three years, starting from the date on which the health care provider's mistake was discovered, or reasonably should have been discovered. However, there are exceptions depending on the specific circumstances that may alter this three-year time frame.
